By accessing or using our services, you agree to comply with and be bound by these Terms in their entirety. If you disagree with any part of these terms, you are advised not to use our services. Your continued use of CayMall constitutes acceptance of these Terms. This consent can be withdrawn at any time by your cessation of the use of this platform.

2. Definitions

  • CayMall refers to the eCommerce platform that connects vendors and customers. This site is owned and operated by Cayman Services (Cayman) Ltd.
  • Vendor means any seller who lists products on CayMall.
  • Customer refers to any individual who purchases products or services from the vendors on CayMall.

3. Eligibility

To use our services, you must be at least 18 years old or the age of majority in your jurisdiction. By using our services, you represent and warrant that you meet this requirement.

4. Vendor Responsibilities

  • Vendors are responsible for the accuracy of product descriptions, pricing, and availability.
  • Vendors must comply with all applicable laws and regulations regarding their products.
  • Vendors must ensure that their products do not infringe on any intellectual property rights.

5. Customer Responsibilities

  • Customers must provide accurate information when creating an account or placing an order.
  • Customers must review product descriptions and terms before making a purchase.
  • Customers are responsible for maintaining the confidentiality of their account information.

6. Payment Terms

  • All transactions are processed through secure payment gateways.
  • Vendors will receive payment for their products according to the agreed-upon terms. CayMall deducts a small commission on each sale and disburses vendor payments through secure channels twice monthly. Payouts are calculated on the 1st and 15th of each month, with disbursements typically occurring within three business days. Vendors will receive payouts for account balances over $50 for products/services rendered to CayMall. Any additional fees or charges will be transparently communicated to vendors through their account dashboards.
  • Customers agree to pay the total amount due at checkout.

7. Shipping and Delivery

  • Shipping policies are determined by individual vendors and should be reviewed before purchase. While CayMall respects the autonomy of vendors to establish these policies, we are committed to ensuring that all vendor policies adhere to industry best practices and consumer protection standards. Should a dispute arise, CayMall may intervene to promote fair resolution in line with these standards.
  • CayMall is not responsible for delays or damages caused by shipping carriers. CayMall serves as a marketplace intermediary and does not take ownership of products sold by vendors or assume liability for vendor actions.

8. Returns and Refunds

  • CayMall offers a subscription-based service to vendors, which provides access to various platform features and benefits. Subscription fees are non-refundable once payment is processed, except in cases where CayMall determines there has been a technical issue or an error in billing. Vendors may cancel their subscription at any time; however, no partial refunds will be issued for unused portions of the subscription period. All refund requests must be submitted through the support portal for review and consideration.
  • Product/service return policies are set by vendors. Customers should review the return policy before making a purchase.
  • Product/service refunds are processed according to the vendor’s return policy.
  • Each vendor on CayMall sets their own return and refund policies, which customers are encouraged to review carefully before making a purchase. While CayMall respects the autonomy of vendors to establish these policies, we are committed to ensuring that all vendor policies adhere to industry best practices and consumer protection standards. Should a dispute arise, CayMall may intervene to promote fair resolution in line with these standards.

9. Dispute Resolution

In the event of a dispute, customers are encouraged to first contact the vendor directly to resolve the matter. If the issue remains unresolved, a formal dispute can be submitted through the CayMall platform within 7 days of product receipt. CayMall will act as an impartial mediator and review the dispute based on available evidence and platform policies. Our resolution decision is final and binding for all parties involved. This process ensures a fair and consistent approach to maintaining trust within the CayMall community.

 

10. Prohibited Products & Services

The sale of the following products and services is strictly prohibited on CayMall:

  • Alcoholic Beverages: Alcohol, spirits, and derivatives.
  • Tobacco Products & Smoking Devices: Including vape products.
  • Illegal Drugs & Substances: And any derivatives thereof.
  • Firearms, Explosives, and Weapons.
  • Counterfeit Products: Including fake or unauthorized replicas.
  • Pyramid Schemes & Multi-Level Marketing.
  • Adult Content or Explicit Materials.
  • Gambling-Related Products: Including lottery tickets, betting tools, or games of chance.
  • Protected Wildlife Products: Items made from endangered species or restricted marine life.
  • Stolen or Fraudulent Goods.
  • Services operating without requisite government authorization: such as immigration or legal advisory without a license.

11. Intellectual Property

All content on CayMall, including text, graphics, logos, and images, is the property of CayMall or its licensors. Unauthorized use of this content is prohibited.

12. Limitation of Liability

CayMall is not liable for any direct, indirect, incidental, or consequential damages arising from the use of our services or products purchased from our vendors.

13. Governing Law

This policy is governed by the laws of the Cayman Islands. 

14. Changes to Terms

CayMall reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after changes constitutes your acceptance of the new Terms.
